By accessing our Site, scheduling a consultation, or executing a service agreement with us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access the Site or utilize our Services.

1. Scope of Services

Capital Book House provides custom, service-based book creation and publishing optimization. The precise deliverables, timelines, milestones, and project fees for any assignment will be explicitly outlined in a separate, personalized Service Agreement or Statement of Work (SOW) executed between you (the "Author") and the Company.

2. Intellectual Property & 100% Rights Ownership

  • Capital Book House acts strictly as a work-for-hire creative agency.
  • We retain 0% ownership of your book's intellectual property, files, text, metadata, or media assets.
  • We take 0% of your royalties.
  • All sales revenue, distribution profits, translation rights, cinematic options, and copyrights remain completely yours.
  • Unless restricted by NDA, we may display completed cover artwork and public testimonials in our portfolio.

3. Absolute Confidentiality & NDA Protection

All concepts, interviews, manuscripts, and materials shared with our team are protected under a strict Non-Disclosure Agreement (NDA) process and will never be shared outside the assigned project team.

4. Author Materials & Representational Warranties

By submitting materials to Capital Book House, you warrant that:

  • You own or are authorized to use all submitted content.
  • The materials do not violate third-party copyrights, trademarks, patents, or privacy rights.
  • The content does not contain unlawful or defamatory material.

5. Payment Structures, Fees, and Defaults

  • Project fees are structured according to agreed milestones outlined in the SOW.
  • Invoices unpaid for more than 15 calendar days may result in project suspension.
  • Payments are securely processed through third-party payment providers.

6. Collaboration, Feedback, and Project Delays

  • Authors are expected to review drafts and concepts within agreed timelines.
  • Extended delays in feedback may result in project timeline adjustments.

7. Global Distribution & Retail Ingestion Frameworks

We assist with distribution through platforms such as Amazon KDP, IngramSpark, Apple Books, and ACX/Audible. However, we do not control these platforms and are not responsible for account suspensions or policy actions taken by them.

8. No Guarantees on Market Performance

We do not guarantee book sales, bestseller status, media coverage, retail placement, or specific commercial outcomes. Success depends on market conditions and the author's marketing efforts.

9. Cancellation and Refund Guidelines

  • Completed project phases and approved deliverables are non-refundable.
  • If a project is cancelled mid-phase, the author remains responsible for work completed up to the cancellation date.

10. Email, Phone, and SMS Consent Protocols

By using our website forms or consultation scheduling tools, you consent to receive emails, phone calls, and SMS communications related to your project. You may opt out at any time.

11. Website Use Limitations

  • No automated scraping, mining, or harvesting of website content.
  • No attempts to bypass security systems.
  • No unauthorized use of our branding, content, or service models.

12. Limitation of Liability

To the fullest extent permitted by law, Capital Book House shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

13. Indemnification

You agree to indemnify and hold harmless Capital Book House against claims, damages, liabilities, and expenses resulting from your breach of these Terms or the content you provide.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, labor disputes, governmental actions, or public emergencies.

16. Entire Agreement

These Terms, together with any signed Statement of Work (SOW) and NDA agreements, constitute the complete agreement between the parties.

17. Modifications to Terms

We reserve the right to update these Terms at any time. Continued use of our Site or Services constitutes acceptance of any revised Terms.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts located in Fort Bend County, Texas.
